1. Acceptance of Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you") and Rentiwise ("we", "us", "our"). By downloading, installing, or using the Rentiwise mobile application ("App") or any related services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
If you do not agree with any part of these Terms, you must immediately discontinue use of the App.
2. Eligibility
To use Rentiwise, you must:
- Be at least 18 years of age
- Be a resident of India
- Have a valid Indian mobile phone number capable of receiving SMS
- Have the legal capacity to enter into binding contracts under applicable Indian law
- Not have been previously suspended or removed from the Rentiwise platform
By using the App, you represent and warrant that you meet all of the above eligibility requirements.
3. Account Registration & Security
To access most features of Rentiwise, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Keep your account information up to date
- Maintain the confidentiality of your authentication credentials
- Accept full responsibility for all activities that occur under your account
- Immediately notify us of any unauthorised access at support@rentiwise.in
We reserve the right to disable any account, at our sole discretion, if we believe you have violated these Terms.
4. Platform Role & No Liability for Transactions
Rentiwise operates exclusively as a technology platform and marketplace facilitator. We do not:
- Own, possess, or have custody of any items listed on the platform
- Guarantee the quality, safety, legality, or condition of any listed item
- Guarantee the identity, creditworthiness, or conduct of any user
- Act as an insurer or guarantor for any rental transaction
All rental agreements are directly between the Lender and Borrower. Rentiwise is not a party to those agreements and accepts no liability for disputes arising between users.
5. Lender Responsibilities
As a Lender on Rentiwise, you agree to:
5.1 Listings
- Only list items you legally own or have authority to rent out
- Provide accurate, honest, and complete descriptions and photos of your items
- Keep your item availability calendar updated to prevent double bookings
- Set a fair and reasonable rental price and security deposit (if any)
5.2 Item Condition
- Ensure items are in good, safe, functional working condition before handoff
- Clean and prepare items appropriately before each rental
- Disclose any defects, limitations, or special usage instructions
5.3 During Rental
- Participate in the Rental Proof process (photos at handoff and return)
- Verify borrower identity using the OTP-based pickup verification
- Be available and responsive during the rental period for support queries
- Report any item damage or loss within 24 hours of item return
5.4 Prohibited Actions
- Do not attempt to conduct transactions outside Rentiwise to circumvent fees
- Do not misrepresent item condition or listing details
- Do not list stolen, counterfeit, or prohibited items (see Section 10)
6. Borrower Responsibilities
As a Borrower on Rentiwise, you agree to:
6.1 Booking
- Only request items you genuinely intend to rent
- Provide an accurate and accessible pickup/delivery address
- Review item descriptions, photos, and lender reviews before booking
6.2 During Rental
- Use rented items only for their intended purpose and in a responsible manner
- Not sub-rent, lend, or transfer the item to any third party
- Return the item in the same condition as received, accounting for normal wear and tear
- Return the item on or before the agreed return date and time
- Participate in the Rental Proof process (OTP-based handoff + return photos)
6.3 Liability for Damage or Loss
- You are fully responsible for any damage, loss, or theft of the rented item during your rental period
- Fair compensation for documented damage may be claimed by the Lender and facilitated through Rentiwise support
6.4 Prohibited Actions
- Do not attempt to conduct transactions outside Rentiwise
- Do not use rented items for illegal, hazardous, or commercially inappropriate purposes
7. Payments & Fees
7.1 Payment Method
Rentiwise facilitates payments through UPI (Unified Payments Interface). By completing a payment, you agree to the terms of the relevant UPI payment provider.
7.2 Rental Charges
Rental fees are set by Lenders and displayed clearly on the listing page. You will see the full cost (including any applicable fees) before confirming a booking.
7.3 Service Fee
Rentiwise may charge a platform service fee on transactions. Any applicable fee will be disclosed at checkout prior to payment confirmation.
7.4 Security Deposits
Certain lenders may require a refundable security deposit. This amount will be clearly indicated on the listing. The deposit is returned in full upon item return in acceptable condition.
7.5 Failed Payments
If a payment fails, the booking will not be confirmed. Rentiwise is not responsible for failed transactions due to third-party payment provider errors. Please contact your bank or UPI provider for failed payment queries.
8. Cancellation & Refunds
8.1 Borrower Cancellations
- Cancelled 48+ hours before start: Full refund of rental amount
- Cancelled 24โ48 hours before start: 50% refund of rental amount
- Cancelled less than 24 hours before start: No refund
8.2 Lender Cancellations
If a Lender cancels a confirmed booking, the Borrower will receive a full refund. Repeated lender cancellations may result in account penalties or suspension.
8.3 Refund Processing
Approved refunds are processed to the original payment method within 5โ7 business days, subject to UPI provider timelines.
8.4 Disputes
In case of payment disputes, please contact support@rentiwise.in within 7 days of the transaction.
9. Rental Proof Requirement
To protect both parties in any rental transaction, Rentiwise requires a mandatory photo-proof workflow:
- At Pickup: The Lender must capture and upload photos of the item prior to handoff. An OTP is verified by the Borrower to confirm receipt.
- At Return: The Borrower must capture and upload photos of the item upon return. An OTP is verified by the Lender to confirm receipt.
Failure to complete the Rental Proof process:
- May invalidate damage claims made by either party
- May result in the dispute resolution process favouring the compliant party
10. Prohibited Items & Conduct
10.1 Prohibited Items
The following categories of items may not be listed or rented on Rentiwise:
10.2 Prohibited Conduct
You must not engage in:
- Harassment, abuse, threats, or discriminatory behaviour toward other users
- Fraud, misrepresentation, or impersonation
- Reverse engineering or attempting to access the App's source code
- Scraping, crawling, or data mining the platform
- Posting false reviews or manipulating the rating system
- Creating fake accounts or manipulating verification processes
- Using the platform for commercial purposes beyond peer-to-peer rental
11. User Content
You retain ownership of all content you submit to Rentiwise (photos, descriptions, reviews). By submitting content, you grant Rentiwise a non-exclusive, royalty-free, worldwide licence to use, display, and distribute your content solely for the purpose of operating and improving the Service.
You represent and warrant that:
- You own or have the right to submit the content
- The content does not infringe any third-party intellectual property rights
- The content is accurate and not misleading
- The content does not contain harmful, offensive, or illegal material
We reserve the right to remove any content that violates these Terms without prior notice.
12. Dispute Resolution
12.1 Between Users
In case of disputes between Lenders and Borrowers, Rentiwise provides a support-mediated dispute resolution process:
- Contact us at support@rentiwise.in or through in-app support within 7 days of the incident
- Submit relevant evidence including Rental Proof photos, OTP confirmations, and chat logs
- Our team will review the evidence and issue a decision within 14 business days
- Our decision is final and binding within the platform, but does not affect your legal rights
12.2 Arbitration
For disputes between you and Rentiwise that cannot be resolved informally, both parties agree to binding arbitration under the Arbitration and Conciliation Act, 1996 of India. The seat of arbitration shall be Chennai, Tamil Nadu, India. The language of arbitration shall be English.
12.3 Class Action Waiver
You agree that disputes will be resolved on an individual basis and not as part of any class, collective, or representative action.
13. Limitation of Liability
To the maximum extent permitted by applicable law:
- Rentiwise's total liability for any claim arising from use of the Service shall not exceed the amount you paid to Rentiwise in the 3 months preceding the claim
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
- We are not liable for loss, damage, or theft of rented items
- We are not liable for service interruptions, data loss, or unauthorised access resulting from third-party actions
The Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied.
14. Indemnification
You agree to defend, indemnify, and hold harmless Rentiwise, its officers, directors, employees, partners, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:
- Your use of the App or Service
- Your violation of these Terms
- Your violation of any applicable law or third-party right
- Any content you submit, post, or transmit through the Service
- Any dispute between you and another user
15. Termination
15.1 By You
You may delete your account at any time through the App settings. Deletion is effective upon processing and subject to our data retention obligations.
15.2 By Rentiwise
We reserve the right to suspend or terminate your account immediately, without notice, if:
- You violate any provision of these Terms
- We receive credible reports of fraud, harassment, or illegal activity
- We are required to do so by law or regulatory authority
- Extended inactivity warrants account cleanup (we will notify you first)
15.3 Effect of Termination
Upon termination, your right to use the Service ceases immediately. Sections relating to liability, indemnification, and governing law survive termination.
16. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India, including but not limited to:
- The Information Technology Act, 2000
- The Consumer Protection Act, 2019
- The Indian Contract Act, 1872
Subject to the arbitration clause above, any disputes shall be subject to the exclusive jurisdiction of the courts of Chennai, Tamil Nadu, India.
17. Changes to These Terms
We may modify these Terms at any time. When changes are material, we will:
- Notify you through the App at least 7 days before changes take effect
- Update the "Last Updated" date at the top of this page
Your continued use of Rentiwise after the effective date of changes constitutes acceptance of the revised Terms. If you do not agree, you must cease using the Service.
